Malawi gay wedding couple denied bail for 'own protection'

Two men arrested after symbolic ceremony last month could face up to 14 years in jail

A court in Malawi today denied bail to two men arrested after becoming the first gay couple to marry in the conservative African country.

Magistrate Nyakwawa Usiwausiwa told a packed court that he could not grant the couple bail, saying the ruling was for their own protection. "The public out there is angry with them," Usiwausiwa said.

Tiwonge Chimbalanga and Steven Monjeza committed to marriage in a symbolic ceremony in southern Malawi last month, attracting hundreds of onlookers. They were arrested at the home they share and charged with unnatural practices between males and gross public indecency.

Malawi convicts couple for being gay
breakingnews.ie 18/05/2010

A Malawi gay couple have been convicted of having a criminal relationship and could face up to 14 years in jail under the country’s colonial-era laws.

They were found guilty of unnatural acts and gross indecency after a trial that drew worldwide condemnation.

Steven Monjeza, 26, and Tiwonge Chimbalanga, 20, had been jailed since their arrest on December 27, the day they celebrated their engagement with a party that drew crowds of curious, jeering onlookers.

Here's a question, and it's something that I've  been wrestling with and have been trying express clearly (unsuccessfully) for the last few days (so interpret it as you will - I'm not suggesting anything one way or the other)...  Is it ethical and/or moral to reduce aid/donations due to governmental actions/laws we don't like?

If you donate to support non religious NGOs like Concern they apparently work to support LGBT people in hostile African countries. I rang them up a few months ago to ask them not to give my money to Ugandan causes anymore and they told me they do LGBT support work there.

They could have just been telling me lies to get me off the phone.

Its a good question. I know that Irish Aid gives about E4.5 million per year to Malawi- its one of the preferred partners for Irish government aid, mainly because its one of the poorest and least developed nations in the world. I also know that a good amount of that money goes into strengthening civil society- e.g human rights organaisations, a number of whom have come out fighting on this issue. However, it is one area where the Irish government has direct influence in Malawi, so it culd be used as leverage to persuade the government to take a stance against the ruling from the judiciary.

I think the threat of withdrawing aid from Malawi will at least open a door to discussion, but everyone will know that withdarwal of aid is unlikely.

Is it possible for the government to specify how the aid is used? Specify a percentage breakdown of areas with a certain amount going towards lgbt support or they'll threaten withdrawal?

I hadn't heard that, if it's true I imagine it only makes matters worse.

Amnesty have an urgent action letter campaign going for them already, and I'm going to call in later and find out what the new plans are.

I've seen this story in a number of places online, and I haven't really commented. I just don't know what to say that could do justice to the horror of it.
